In Florida, three agencies regulate food businesses and each one oversees different things. Knowing them before you open saves you fines, closures, and repeated paperwork.
Florida Department of Agriculture and Consumer Services
Packaged, processed, and retail food sales.
Regulates the production, processing, storage, and sale of packaged or processed foods not consumed on-site. If your business manufactures, packages, or distributes food like jams, sauces, wholesale bakeries, butcher shops, or grocery stores, FDACS is your primary agency.
Florida Department of Health , County Health Departments
Assisted Living Facilities • Adult Day Care • Certain Group Care Facilities • Schools & Institutional Food Service
Florida Department of Health regulates food sanitation in certain institutional and residential facilities, including assisted living facilities, adult day care centers, qualifying group care facilities, schools, and other food service operations under DOH jurisdiction. Requirements may vary depending on the facility type, food service level, population served, and facility capacity. Applicable requirements may include Chapter 64E-11, F.A.C., food sanitation permitting, Certified Food Manager requirements, plan review, training, and inspection readiness.

The DBPR Division of Hotels and Restaurants is the agency that most affects independent restaurants in Florida. It licenses, inspects, and sanctions all establishments where food is prepared and served to the public, from a family restaurant to a fast-food chain.
